Terms of service

The following Terms and Conditions (β€œAgreement”) govern all services provided by Fall Into Pumpkins (β€œCompany”) to the client (β€œCustomer”). By placing an order, the Customer agrees to be bound by the terms set forth below.

1. Limitation of Liability for Plant Health
The Company shall not be held liable for any damage to or death of plants after installation. The Company provides healthy plant materials at the time of delivery; however, due to varying environmental conditions and maintenance practices, the Company makes no guarantee regarding the longevity or continued health of any plant material once installed. The Customer assumes full responsibility for the care of all plant materials following delivery.

2. Watering Responsibility
The Customer is solely responsible for the watering and ongoing maintenance of all plant materials. The Company does not provide watering services unless expressly agreed to in writing in a separate service agreement.

3. Pest Deterrent Treatment
Any pest deterrent products applied by the Company are effective for a maximum period of twenty-one (21) days from the date of application. The Company makes no warranty, express or implied, regarding pest control effectiveness beyond this period. Additional treatments may be requested by the Customer for an additional fee.

4. Delivery and Pickup Scheduling
The Company shall make reasonable efforts to deliver and/or retrieve displays during the week scheduled by the Customer. However, the Company does not guarantee specific delivery or pickup dates. Delivery and pickup are subject to route planning, weather conditions, and other logistical factors. The Customer acknowledges and agrees that delivery or pickup may occur on any day within the scheduled week.

5. Customer Obligations
The Customer shall provide safe, accessible, and clear access to the designated delivery and pickup location. The Company shall not be held liable for any delay or inability to perform services due to obstructed, hazardous, or otherwise inaccessible conditions.

6. Acceptance of Terms
By placing an order with Fall Into Pumpkins, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions in full.

7. All Sales Final

All sales are final. Due to the seasonal nature of the products and services provided, the Company does not offer refunds, returns, or exchanges once an order has been placed and accepted. In the event of a cancellation request, the Company reserves the right to determine whether any refund or credit is warranted, at its sole discretion.

8. Weather-Related Impact

The Company shall not be liable for any damage, loss, or degradation of materials caused by severe weather conditions, including but not limited to high winds, heavy rain, frost, or extreme temperatures. The Customer assumes full responsibility for displays once installed.

9. Photography and Marketing

The Customer grants the Company permission to photograph displays on their property for marketing and promotional use, unless otherwise requested in writing prior to installation.
